TERMS & CONDITIONS for reservations from 16th Aug 2023

Important:

By using or accessing escape-villa.com a subdomain of any such websites, any mobile application for such websites or any other website operated by us on which these Terms and Conditions are posted via a link or otherwise (each referred to herein as a “Site”), you acknowledge and agree that you are subject to the following terms and conditions, as well as our Privacy Policy, which also governs your use of the Site. The Terms constitute a legally binding agreement between you and escape-villa.com. The Site provides an on-line marketplace to allow Villa Escape homeowners to offer for rent vacation property to potential renters. We also may offer online booking or other tools or services to allow users to communicate with Escape-villa property owners and enter into rental agreements or other transactions. 

I. DEPOSIT POLICY 

A 50% deposit is required to secure a booking of traveling guest by Credit Card,  PayPall or wire transfer due when the reservation is booked. You will automatically be confirmed, if you make a payment. The property will then be booked for your requested dates. Please send your payments in on time to avoid cancellation of your reservation. Any late payments will be accepted only at the discretion of the Villa-Escape.com and may result in the cancellation of this agreement. No rights can be derived from any provisional confirmation. The balance of 50% is due latest 59 days prior to arrival date for short term stays ( 1-20 nights) and 93 days prior to arrival date for long term stays ( 21 nights and more) 

II. CANCELLATION POLICY

Short term stays ( 1-20 nights) 

Full refund for cancellations made within 48 hours of booking, if the check-in date is at least 21 days away. 

50% refund for cancellations made at least 32 days before check-in. 

No refunds for cancellations made within 31 days of check-in.

 If a reservation is for 21 nights or more, the long-term cancellation policy applies.

 122 days to 93 days prior to arrival : 30% of the total rental costs. 92 days to 61 days a prior to arrival : 50% of the total rental costs. 60 days and more or no show : 100% will be charged. 

Please note : Villa should be notified in writing of all cancellation or changes. In case of no-show or early check-out, 100% of all estimated charges will be charged. Changes to reservation arrival and departure date(s) are subject to a separate cancellation policy is applicable for high peak season bookings (from 20th Dec to 29th Feb) - please note that if the booking for high peak season is/are cancelled, due to whatsoever reason, no refund would be made for said cancellation. All reservations payments are non-refundable. Reservations canceled at times of natural disasters or health-threatening pandemics are not returned and guests are advised to take out individual insurance. Cleaning fees are always refunded if the reservation is canceled before check-in.Payment transfer costs are not refundable. Guests requesting a refund of any kind (i.e. cash or credit voucher) should be aware that it may take up to 90 days from the date of cancellation for the refund to be processed.

III. CHECK-IN & CHECK-OUT 

CHECK IN : 4:00 PM - 8:00 PM (16:00 - 20:00) CURAÇAO time, CHECK OUT : 8:00 AM - 11:00 AM CURAÇAO time The early check-in or late check-out may only be agreed if it allows the arrival and departure of other guests . Has to be confirmed by the property manager. A fee of $ 250.00 /day time and $ 350.00 night time (8:30 PM - 7:30 AM ) is charged.

IV. PRICE INCLUDED 

 Villa rent for your specific days( The price of the rent does depend on the number of guests in the villa. The villa is rented only to you as a private entire house.) Payment fee, Tax, WIFI connection 24/7, Bed linen & towels, Beach towel & bathrobe, Basic Kitchen & Laundry essentials, Pool cleaning: once a week, Security service in gated resort 24/7, Personall check in service, Welcome drink & Villa Tour, 8/7 customer emmail & Whats up support, Energy & Water average consumption 30.00USD /night, Personal Check out & Goodbye, Final cleaning. 

V. REFUNDABLE DEPOSITS : DEMAGE  & UTILITIES  

Refundable Demage Deposit : 1 000, 00 USD 

You must provide Villa-Escape.com with a 1000,00 USD refundable security deposit payment due 2 weeks prior arrivall to confirm your arrival. A payment order will be sent to you 3 weeks before your scheduled arrival piayable via Credit Card (+ 4.5% -  charge per transaction) or Bank transfer (0% -2,5 % charge per transaction). Payment fees are not refundable. Security deposit act as collateral for any losses or damages to the property or to the real estate (including its contents) during the rental period and the Villa-Escape.com charge the amount of these losses or damages. The security deposit must be returned to the tenant within 15 days after check out, unless it is being held as compensation for damages. </p>

Refundable energy &, water Deposit : 400,00 USD/week 

Payable cash on-site when check in. Rates are inclusive the average consumption of energy and water 30.00USD /night. In case of higher consumption, these cost will be deducted from the deposits at the end of your stay or the client undertakes to pay the difference on the spot when check out. Guests can check the current consumption at property meters anytime. Prices are listed at https://aqualectra.com/ The resulting consumption will be calculated at check out and the guest will be provided with a detailed table of total energy consumption on site at departure. In case of internet outage, it will be sent by email the same day.

VI. DISCLAIMER- INJURY, LOSS, DAMAGE 

Guests are aware of their sole responsibility to the property or to the real estate (including its contents) and health and waive the right to claim any damages to the owner. Villa owners and Villa-Escape.com management cannot be held responsible for any loss of personal belongings, cash or valuables, room safes are provided and recommended for guest use. In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website. In no event will escape-villa.com or it’s agents and/or employees, or any third party provider of a service be liable for any lost profits or any indirect, consequential, special, incidental or punitive damages arising out of, based on, or resulting from our site, these terms, any breach of these terms by you or a third party, use of the site, tools or services we provide related to the business we operate on the site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any vent settle any matter without our written consent. We may assign our rights and obligations under these terms, and upon such assignment, we shall be relieved of any further obligation hereunder. Any and all Claims will be resolved by binding arbitration according to the registered local affiliation of the company escape-villa.com , rather than in court affiliation . This includes any Claims you assert against us. 

VII.  MISCELLANEOUS / RESPONSIBILITIES / COMPLAINTS . In order to avoid misunderstandings Villa-Escape.com is not required to provide any compensation for the points listed below :     Power or water supply faults, loss or misuse of third party service providers; -  Temporary disruption of equipment and accommodation; - Obvious errors and damages made by the previous guests of any nature whatsoever; -  Theft, damage or loss during rental of accommodation; - Accidents in the vicinity of the accommodation and surroundings; - Nuisance from construction or other activities outside the rented accommodation and own property; -  Weather impacts on real estate - rain, wind, sun, etc.  -   Higher assets of any kind. Personal opinions are not considered a complaint. No refund will be considered in this situation. Villa-Escape.com nor their representatives will be liable for any complaint submitted after the rental period. 

VIII. SUBSTITUTION. Villa-Escape.com reserves the right to substitute comparable or better accommodations without liability, should the property/ real estate out of order. Guest waives the right to claim consequential costs on the landlord.  20. Force Majeure. Villa-Escape.com  and their representatives are not responsible for refunds if the fulfillment of contractual obligations is influenced by “force majeure”. In these Terms, “force majeure” shall mean any event that the lessor or service or service provider has not expected or prevented. Such events may include, but are not limited to, electricity or water disconnections, war, civil unrest or conflicts in the area, hostilities, strikes or other industrial disputes, natural disasters, fire, terrorism, quarantine, epidemics, weather conditions, government actions, damage caused by previous guests or other events. 

IX. COMMUNICATION  We will always be here to help as it will be possible for us at that moment, but no feedback time can be guaranteed. But we always try to give a helping hand immediately. X. HOUSE-RULES 

I agree and acknowledge, that when entering and using the property and unsupervised pool, I do so at my own risk , agree with property rules and the Villa Escape shall not be liable for any such personal injury, death or property loss and/or damage. 

XI. DISPUTES  All disputes arising from the rental of the property, will be resolved between the tenant and the Villa-Escape.com . In any dispute arising out of this rental agreement, the local laws apply and the prevailing party shall recover its costs, expenses and reasonable attorneys' fees.  

I hereby acknowledge having read the General Terms and conditions & Rental Policies, which provide important information regarding my responsibilities relating to payment, cancellation, security deposits and other essential elements.   Notwithstanding any method of payment, I agree that I am personally liable for all costs and charges incurred in the event that any such costs and charges are not paid in full and confirm that my responsibility and liability in that regard is not waived or released in any way. I hereby declare that I am the main guest and all of our guests, hereby declare that I have no reservations to the above and this is confirmed.

General Terms and conditions &  House Rules  act as a contract , saved and can be referenced.
