 General Terms and conditions & Rental Policies (page 1-9)

Currant updates :  Extenuating circumstances policy and the coronavirus (COVID-19)

 For a stay scheduled between May 1st, 2020 and December 31th, 2020 inclusive, guests may cancel their reservations and receive a credit voucher only for the full value of their reservation for use at the same villa.

All bookings are accepted by Villa Escape  are subject to the following legal rental agreement, which completely has to be accepted by the tenant/main guest  and all persons in his company.  

Important information about your trip : 

Check the health requirements and additional entry documentation on the government’s websites of the countries you’re travelling to and from, and transferring in. Some countries won’t let you enter without the proper additional documents related to the Corona crisis. Make sure to check the requirements shortly before your trip. 

1. Booking terms. 

These are the terms and conditions for the booking agreement between you and  Attn: Legal Department for the rental of a property Villa Escape.  For the purposes of this agreement, “you” means, collectively, the person signing this agreement and each of the other guests booked to stay at the Property during the rental period as listed in the guest list.

 2. Binding nature.

This agreement becomes binding when submitted electronically or signed by you or once the has received your initial payment, whichever occurs first.

3. Property/ Real Estate “ Escape Villa “

 Rented  Property“ Escape Villa is rented only to you as a private entire holiday house that its not subject to any hotel type accommodation or security construction  regulations.

4.  Guests.

4.1.  The Main Guest - individual booking the Property must be aged 25 years and older at the time of the booking, such individual must also be a traveler. All bookings made may be subject to age verification.  reserves the right to deny reimbursement on the deposit and/or payment of the Booking in the event of an age requirement violation.

4.2. The maximum guest in the villa is 10 (adults and kids).The maximum infants in the villa  is 2.Should a group misrepresent themselves, they will be required to pay for all excess persons immediately, or shall vacate the villa immediately, without refund. Exceptions to this Term are made only for infants under 48 months old at the time of travel. 

 4.3. At time of check in, all villa Guests are required to provide property manager with filled GUEST CARD and identification (passport copy, flight details) for all children under 18 years accompanying the adults in the rental party.

 4.4. You refuse to provide the proper identification, you hereby accept the risk of being refused access to the Property. All identification provided will remain confidential and will not be stored, transferred or used by any third party. In the event of an emergency or security alert, guests information may be disclosed for safety and damage investigation  purposes.

The price of the rent depends on the number of guests in the villa.

The price is increasing according to the final number of guests. Infants (0-2) are free of charge.

Rates may be subject to change without notice, this obviously has no effect on existing reservations. Villa Escape reserves the right charge per night cancellation fee should you cancel any nights from your originally intended length of stay.

 A) airport transfers, grocery shopping, extra cleanings, car rental… is supplied by local providers who operate independently - company  Quick fix - Mrs. Kelly Lopez .  All orders, agreements and payments of additional services  are made directly with her.  Her actual prices are listed at  If you are interested in any of these  additional services such as grocery shoppings, extra cleaning during your stay, transfers from the airport , car rental etc, please arrange all the details with this supplier directly, so she  can prepare with her team for your stay and  can arrange everything nicely  for your arrival.

 6. Refundable demage deposit.

You must provide  with a 1000,00 USD refundable security deposit piayable via PayPal or Credit Card + 3.5% charge per transaction to act as collateral for any losses or damages to the property or to the real estate (including its contents) during the rental period and the charge  the amount of these losses or damages. 

In case of no damage, deposits are refundable within 7 to 14 days of your departure, provided there is no breakage, damage, missing items, no additional cleaning for villas left abnormally dirty and no other charges incurred before, during or after your stay, still outstanding. 

You hereby agree to pay the cleaning or replacement costs for all damages to personal property or to the real estate, which may occur as a result of your occupancy. You as the Guest agree to take all reasonable steps to ensure that your family and other guests in your party adhere to the rules and regulations affecting your villa. 

7. Bookings/ Reservation process.

7.3. Changes to your booking

If you must change or cancel any portion of the villa stay or services you have already booked, you must notify us IN WRITING by email. No-shows, late arrivals, a reduction in number of guests in your group or changing dates within 45 days of or after your arrival are non-refundable. Please note, if booking is modified, it will be dealt on the basis of individual possibilities  of Villa Escape individually. If guests are reduced, a fee of USD 25.00 per guest per night is deducted for the entire stay.  Guests who abandon Villa during rental period  without written agreement from   agree they have no rights to compensation. 

8. Payments methods and instructions. 

8.1 Payments instructions for - direct booking.

We split the total amount in 2 installments:  

The first payment :  50% of the total villa rent price due when the reservation is booked. 

The second payment : remaining 50%  61 days prior to your arrival. 

 Please send your payments in on time to avoid cancellation of your reservation. Any late payments will be accepted only at the discretion of the  and may result in the cancellation of this agreement. No rights can be derived from any provisional confirmation.

When you make a reservation, you will receive a Vacation Rental Confirmation/Payment  from us requesting your deposit on the Villa Escape.  

This Vacation Rental Confirmation becomes a binding agreement when you send us your rental deposit; it states the terms and conditions concerning this villa rental between you (the "Guest") and . Your sending payment in response to this invoice constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as printed below. If you have any problems or questions with any of the following, please be sure to email us for discussion and explanation before you send us your rental payment monies.

8.2. Payments methods for - direct booking.

8.3. Payments for - AIRBNB, VRBO etc

Please note Airbnb and Vrbo does add their own service fee so the final price is increased. 

All payments, receipts and communication when booking viaAirbnb and Vrbo channels are made directly with them.

9. Cancellation policy.

To cancel your booking, you must provide the with written notice of your cancellation via email at . 

For a stay scheduled between May 1st, 2020 and December 31th, 2020 inclusive, guests may cancel their reservations and receive a credit voucher only for the full value of their reservation for use at the same villa.

Free cancelation 

For bookings caneceled within 24hours of booking, no changes are charged and only if there are at least 31 days left until the date of arrival. 

Short term cancellation policy 

The short term cancellation policy applies to all reservations of 27 nights or less.

61 days & prior to arrival - 50% of total rental cost.

45 days to 32 days prior to arrival - 70% of total rental cost.

31 days & less, prior to arrival or no show - NO REFUND.

Travelers who cancel at least 61 days before check-in will get back 50% of the amount they've paid. If they cancel between 32 and 45 days before check in, they will get back 30% Otherwise, they wont get a refund. 

Long term cancellation policy 

The Long Term cancellation policy applies to all reservations of 28 nights or more.

The most flexible Long term cancellation policy we can offer to our direct guests means 70% refund for cancellations made at least 61 days before check in, no refund for cancellation made within 60 days of the check in. 

121 days & more prior to arrival - full refund

120 days to 61 days prior to arrival - 30% of total rental cost. 

60 days & less, prior to arrival or no show - NO REFUND. 

 We recommend our guest to consider adding trip insurance from Generali or other insurance companies. Arranging a travel insurance for your stay may cover your non-refundable trip costs if you have to cancel because you or a companion gets sick or injured before your trip. For better coverage, we suggests purchasing a "Cancel For Any Reason" policy, which offers more flexibility. As the situation evolves, we’ll be updating this page with the latest details on coverage of our extenuating circumstances policy.)

Please note : A separate cancellation policy is applicable for high peak season bookings (from 20th Dec to 30th Jan) - please note that if the booking for high peak season is/are cancelled, due to whatsoever reason, no refund would be made for said cancellation and all reservations payments are non-refundable. Reservations canceled at times of natural disasters or health-threatening pandemics are not returned and guests are advised to take out individual insurance. Cleaning fees are always refunded if the reservation is canceled before check-in.Payment transfer costs are not refundable. 

10. Electricity and water.

Rates are inclusive the average consumption of energy and water ( 3,5 USD per paying guest/ night).  In case of higher consumption, these cost will be deducted from the deposits at the end of your stay  or the client undertakes to pay the difference on the spot when check out.  Rates are inclusive teh average consumption of energy and water in the amount 3,5 USD / per paying guest / night. Min 6 x 3,5 = 21 USD /night Max 35 USD/ night so it ranges from 147,00 USD to 245,00 USD per week. How much electricity and water covers that  ?  Depends on the Aquaelectra current rates that changes every month.  Usually the rates are 0,7 Nafúkwh= O,4 USD/ kwh and 16 Naf/m3 of water = 9.20 USD/m3, so it covers average consumption of utilities that ranges from 6 guests ( 5m3 and 259 kwh per week) till 10 guests ( 10m3 and 382 kwh).

In case of higher above- average  consumption, these costs will be deducted from the deposits at the end of your stay or the client undertakes to pay the difference on the spot when check out via Credit Card or Cash on site. 

Guests can check the current consumption at property meters anytime. Prices are listed at The resulting consumption will be calculated at check out and the guest will be provided with a detailed table of total energy consumption on site at departure. In case of internet outage, it will be sent by email the same day. Electricity and water meter status is supplemented with photos of meters on the day of arrival and departure.  The total consumption is always very individual, especially according to the frequency of use of air conditioners, which are equipped in all rooms of the villa.

- Please remember, its 220v in Escape Villa, Curacao, so you might need adapters or dual voltage.

The villa is equipped with 8 pieces  of adapters from 220V to 110V.  In the case of a electric power failure, energy will usually recover within a few hours and the water supply can be interrupted.  For further questioning about the current situation please , contact the property management or Security at the gate. 

- The Villa has a connection to the normal water supply to use as drinking water. For further water quality information, contact AQUAELEKTRA , Curacao.

11. Liability  - Responsibility, Injury, Loss, Damage.

Guests are aware of their sole responsibility to the property or to the real estate (including its contents) and health and waive the right to claim any damages to the owner.

Guests should ensure that all doors are properly secure at all times  during occupancy.  Guests  must lock all windows and doors securely at all times when not on the premises, and must exercise care in securing all property and all cautions as given in our Guest Guide and fully are responsible for its compliance. 

Villa owners and management cannot be held responsible for any loss of personal belongings, cash or valuables, room safes are provided and recommended for guest use.

Villa owners and  may not be held liable for the cost of damage, personal injury, illness, safety , death, loss and / or damage and  accidents in any form caused by any building elements, equipment or property in their possession suffered by You/All guests  or any other visitors of your party during the rental period or thereafter.  

In the event of an accident, injury,  health problems or crime, guests must contact the emergency hospital  and Curacao authorities directly.  does not provide first aid, medical or investigation services or their mediation. 

Villa owners and , the property - real estate is  privately owned. The  reserve the right to refuse service or rentals to anyone at their complete discretion. Villa Escape is not responsible for printing or publishing errors, inadvertent omissions, or for the content of any other web sites.

12. Damages to the personal property or to the real estate / amenities and inventory.

 The guests takes over the state of property, real estate  and its equipment according to a detailed delivery protocol with which they agree and to which the initial condition of the property is applied.

Damage should always be reported immediately to  and Property Manager. 

Self repair of damages or purchase of broken replacement equipment is not allowed.   

In case accidental damage such as re-keying costs, stained bedding and walls  sewer or toilet clogging etc, the property manager will arrange the repairman in the shortest possible time and arrange for the repair. Guests are required to allow immediate repair. 

Reported damages  with a total of $ 50 in total will not be charged, with a total up to $ 1000 in total will be deducted from the damage deposit.  If the amount of damage to the property or to the real estate exceeds the amount of Refundable  Damage Protection $ 1000 the guest undertakes to pay for damage incurred  invoices and costs immediately  on site  prior departure.  Payment methods : Cash on site,  PayPall or Credit Card ( Visa, Master). 

Damage is meant any damage or restriction on the use of the property/real estate/  amenities and inventor  or damage that occurred during the rental period and was found at the latest 5 days after guests departure. If, as a consequence of the damage, the villa cannot be rented to following guests under normal conditions,  guests who caused the damage or during their stay the damage became agree to pay compensation.

Registered guests will be held responsible for any missing or damaged items in the property  or any internal/external areas of Villa . This liability extends to both registered guests and their visitors.

13. Villa Escape recommend Insurance.  suggest to all  guests to help protect them from paying out of pocket for accidental damages caused to rental or belongings during their stay and purchase Max Protect Property Damage Protection to provide protection against expenses due to accidental damage.  visit . OR ANY OTHER International Personal Liability Insurance while traveling. 

In case the guests do not have insurance,  will take legal action to withhold  is not obliged to prove which of the guests caused the damage and will automatically request payment from the main guest. 

 In the case of damage to property and equipment, it is not possible to cover these damages  from the property insurance of the owners, as the insurance provider company   is not obliged to reimburse damages caused by the villas guests. Guests  therefore hereby declare that they undertake to pay all the damage incurred on the spot by the specified payment methods prior to leaving the property. 

14.Complaints and maintance. shall make every effort to keep property and its inventories in good working order. In case of a maintenance problem, they will strive to repair the problem as soon as possible after being notified. They reserve the right to be allowed to cure a reported problem. However, no refund or rate adjustment shall be made for unforeseen mechanical failures of the property and real estate such as the supply of electricity, internet service, water, pool filtration systems, jacuzzi,  air conditioning, appliances, etc. It is the Guest's obligation to report any problems or damage to their villa IMMEDIATELY to us, regardless of the hour. 

15. House  rules  wishes to maintain a family atmosphere for the quiet enjoyment of Guests.    We rent to family groups and responsible adults only; absolutely NO house parties, commercial use or functions such as weddings are allowed without advance WRITTEN permission. Guests shall be sufficiently quiet and peaceful, so as not to disturb other residents of the neighborhood. 

Its strictly forbidden under the $ 1000,00  fine to:

15.1. Use of the villa by non paying guests                                                                                                                                                     It is strictly prohibited to accommodate and use of Villa Escape and its equipment, pools, garden and parking spaces etc. by non-paying guests and visitors, realize social events and  filming for public purposes during your stay without the prior written consent of the . If Guest is found to have had a wedding or any sort of group gathering for more persons than officially scheduled and paid for at the villa,  without advance written permission, main guest is subject to forfeiture of his entire villa security deposit to  at the joint discretion of 

15.2. Disturbing night silence from 10pm/ 22.00                                                                                                                                       The villa is situated in one of the most beautiful places in the South-West coast of Curaçao, in Coral Estate, Rif St. Marie, where freedom, peace and quiet are key words & vital. Night silence from 10pm/ 22.00  Loud parties and noise are frowned upon. Quite Hours start at 10pm **If we receive noise complaints repeatedly, the resort chamber will require you to leave the resort and the villa and no refunds will be issued**

15.3. Smoking in the villa or any open fire is strictly forbidden.

15.4. No pets !  Pets of any kind are NOT allowed in or on the villa's premises without specific written permission from  A pet or evidence of a pet found on premises will cause immediate eviction, and forfeiture of Guest's entire rent and deposit.

15.6. Illegal substances : To use or brought into villa any illegal substances, flammable fluids (e.g., gasoline, kerosene, naphtha or benzene), or other explosives or articles deemed hazardous to life, limb or property.

15.7. Throw anything other than toilet paper and what nature provides into the toilet and waste. The Villa is equipped with a pumping system that breaks down if anything is thrown away. Repair costs are to 2500.00USD  therefore  warnings are placed on all toilets. It may not be possible to repair it immediately and repair can take several days. If there is a guest, no further accommodation or other refunds will be provided.

15.8. Leave  without taking over the property personally by the property manager. If the main guest leave the property without taking it over personally to the property manager, loses the opportunity to prove that the potential damage has not occurred and undertakes to pay the damages reported in the check out protocol in full.

15.9. Others house rules :  

  •  Parents with children are responsible for the safety of their children. Children under the age of 18 can not stay alone on the property and should be supervised by adults at all times. Parents are responsible for any damages and crisis situations caused by children or to children.
  • Although you are in a protected area, we recommend that you do not leave valuables and use safes in the rooms for your valuables.
  • The use of the BBQ/ Gas Grill and Gas bomb at your own risk. Barbecue is only allowed at the BBQ area and is not allowed to remove it on the  terraces or pool deck. The gas grill must be properly switched off and check twice to ensure that everything is in order when you are finished. For the entire period of operation  adult supervision is recommended. If you are unsure, sprinkle water the green area around the BBQ. 
  •  To dive  and jump in the swimming pools and/or to extract other dangerous antics. It is strictly forbidden to jump  from the first floor terrace in the underlying pool.
  •  Rearranging the furniture or removing any items from the villa is prohibited. There are 4 exterior security  cameras for your safety  monitoring driveway gate , entrance doors, storage doors and garden gate. NO INTERIOR or POOL cameras!!
  • You/ Guests agree to able  possibility of inspection during the duration of the villa rent  by the property management in the case of suspected damage or other unauthorized property use.

 16. Access Gateway.

Coral Estate Resort is a secured premier resort  with a guarded gate. As a tenant you will upon arrival need to identify yourself to the security guard and give the villa number 202 where you stay. You must give the villa number 202 to the security every time you leave and enter the Coral Estate Resort  DIRECTIONS : CORAL ESTATE RESORT, VILLA NO 202

17. Arrival & departure.

 CHECK IN :     4:00 PM - 8:00 PM  (16:00 - 20:00) CURAÇAO time

CHECK OUT :   8:00 AM - 11:00  AM  CURAÇAO time 

The early check-in or late check-out may only be agreed if it allows the arrival and departure of other guests . Has to be confirmed by the property manager. A fee of $ 150.00 /day time  and $  250.00 night time (8:30 PM - 7:30 AM )  is charged.  This fee must be paid prior to arrival at the property's cash manager. 

Please note that the handover of the villa takes at least 30 min. Check in and check out can only be made in the presence of the main tenant, who made the reservation and paid security deposit. Departures and arrivals of other guests must take place in the same time or connection with the arrival and departure of the main tenant.

Pre-termination is not allowed. Extensions will be subjected to availability and rate adjustments.

In case of any early check out, main guest must inform property manager at least 48 hours in advance, to schedule earlier check out term. Guests will not be allowed at the Property unless payment has been received in full.

18. Miscellaneous / Responsibilities / Complaints.

In order to avoid misunderstandings is not required to provide any compensation for the points listed below :  

-   Power or water supply faults, loss or misuse of third party service providers;

-   Temporary disruption of equipment and accommodation;

-    Obvious errors and damages made by the previous guests of any nature whatsoever;

-   Theft, damage or loss during rental of accommodation;

-    Accidents in the vicinity of the accommodation and surroundings;

-    Nuisance from construction or other activities outside the rented accommodation and own property;

-   Weather impacts on real estate - rain, wind, sun, etc. 

-   Higher assets of any kind.

Personal opinions are not considered a complaint.  No refund will be considered in this situation. nor their representatives will be liable for any complaint submitted after the rental period.

19. Substitution: reserves the right to substitute comparable or better accommodations without liability, should the property/ real estate out of order. Guest waives the right to claim consequential costs on the landlord.  

20. Force Majeure.  and their representatives are not responsible for refunds if the fulfillment of contractual obligations is influenced by “force majeure”. In these Terms, “force majeure” shall mean any event that the lessor or service or service provider has not expected or prevented. Such events may include, but are not limited to, electricity or water disconnections, war, civil unrest or conflicts in the area, hostilities, strikes or other industrial disputes, natural disasters, fire, terrorism, quarantine, epidemics, weather conditions, government actions, damage caused by previous guests or other events. 

21. Communication.

22. Disputes.

All disputes arising from the rental of the property, will be resolved between the tenant and the . In any dispute arising out of this rental agreement, the laws of Curacao tshall apply and the prevailing party shall recover its costs, expenses and reasonable attorneys' fees.
